So it took a while to get to that update that I promised. As it is, I still haven’t had time to get to editing and uploading the rest of the pics from the trip and organizing the last photo dump.<\/p>\n\n\n\n
Well a lot has been going on in the past week, so I’ve been somewhat preoccupied. Where to begin?<\/a><\/p>\n\n\n\n Well for starters I killed my business and started working at a new job. Killing my business was one of the hardest things for me to do, but it was the best decision to make at the time. I can’t help but feel like a part of me died with it… it’s hard when you put so much energy and effort into something. But my business partner, who is now full time military, agreed and conceded to the fact of it’s demise long ago. Oh well, I should have listened to him then… it would have saved me many headaches. Such as this one:<\/p>\n\n\n\n Normally I work only for attorneys directly, and never have contact with their client… who I’m actually doing the work for. Well this was a Small Claims case that was referred to me by an attorney who didn’t want to deal with something this trivial. The clients were a mother and son who were suing a former tenant who allegedly stole a hottub from the property. Apparently another tenant had left the hottub and defaulted on some money owed, so the mother and son kept the hot tub as compensation. Well when this other tenant moved, she took the hottub, and was suing the mother and son for something in Small Claims as well. (My work was actually a counter claim in the case…) I don’t care who is right or who is wrong… I just serve the paperwork.<\/p>\n\n\n\n Well apparently the mother and son had tried to serve the former tenant in the past through the Sheriff’s Department, but they had no luck. Enter Darian. So, I try to serve the former tenant a number of times, twelve times to be exact, and have no luck. (My normal number of attempts is five before aborting or charging more.) The closest I came was once when I pulled up to the house, she and her boyfriend were in their car and leaving. I quickly backed up to turn around but she saw me and took off with tires screeching. I actually followed her for a little bit, but once she started blowing through stop signs and such I decided to cease the pursuit.<\/p>\n\n\n\n Anyhow, many attempts later it’s the day I’m leaving for DC. I try one last time then call to let them know that I couldn’t get the lady. I had talked to them previously about contingencies and in the message that I left I reiterated those options. I also informed them that I would be on vacation for more than a week and would contact them upon my return. That was Thursday, May 20th.<\/p>\n\n\n\n Friday, May 21st, I am at Arlington National Cemetery watching the changing of the guard at the Tomb of the Unknown Soldier. My phone rings. Fortunately, I did have the foresight to turn my ringer off while on those hallowed grounds. It was the Mother. For whatever reason she had it in her head that my message meant that I was on vacation that one day and would be calling her on Friday. At this point she was still a “valued” client and I was doing my best to be polite with her as I tried to get off the phone. Fifteen minutes later I am finally successful after informing her that I would call when I returned from my vacation.<\/p>\n\n\n\n Throughout the trip I received telephone calls from them. Because of spotty mobile service in parts of the journey the telephone calls all went to voicemail. There were no real messages, just the son talking to the mother, “oh he’s not answering… I’ll try again later.”<\/p>\n\n\n\n Sunday, May 30. We roll back into Sacramento… and no more than the time it took me to take a leak and start to check the mail does my phone ring. Instinctively I answer. Guess who?<\/p>\n\n\n\n So the son is asking for a status report. Yes, he is asking for a goddamn status report after I told him that I was on fucking vacation and would call him when I returned. I, mustering up everly last ounce of restraint, told him that I had just returned and would call him the next business day. “Oh, you’ll call me tomorrow?” he replied. “NO… tomorrow is a HOLIDAY… I’ll call on Tuesday when I get rolling.” He wasn’t too pleased with that answer but he seemed to accept it.<\/p>\n\n\n\n Tuesday, June 1st. By now I had already decided to kill the business and was drafting memos to my clients and making arrangements for another service to take over my workload. It’s still relatively early in the morning… and guess what? My phone fucking rings. Guess who? Yes, it’s the son again.<\/p>\n\n\n\n Now by this time I’m getting really pissed off. Still trying to maintain composure I informed the son that I was busy and that _I_ would call _HIM_ when I was done. He started whining about his case and this and that and blah blah blah blah blah… then he crossed the line. He swore at me.<\/p>\n\n\n\n “We’ll you’re just fucking up!” he blurted out. Excuse me? That did it. I lost it. All the restraint that I had previously maintained was out the fucking window. And I let him know it. Gratuitously using “fuck” about every other word I let him know that in no uncertain terms was my quality of work lacking nor was my lever of service substandard. I also let him know that while the tenant wasn’t served, I had completed my part of the job by making the needed number of attempts and that I was rightfully able to cash the piddly $40 check that his mommy wrote out. I also let him know that because I am such a nice fucking guy that I wasn’t going to cash the check because in all honesty I didn’t ever want to hear from them again and that they would be better served by finding someone else to take care of the job. At this point he started swearing back and whining about how he didn’t know who to call so I hung up the phone.<\/p>\n\n\n\n Wednesday, June 2nd. I started my new job that day. Things were going pretty well until the drive home… and wouldn’t you know it, my phone rang. Guess who? No dumbass, this time it was his mother… and she started going off on me about how I have to do my job and serve the tenant, etc. I informed her that in no uncertain terms was I going to be doing business with them at all and that she was not to contact me any further. She screamed and yelled about how her son told her that I could have served the tenant but didn’t. She then demanded her check back.<\/p>\n\n\n\n Now I’ve been pretty reasonable. I thought that I was even being a nice guy by not cashing the check, even though I easily earned the money. Hell, I went well above earning the money. If I wanted to, I could have charged them at the standard rate after five attempts… which is time and mileage. But no, I was being nice and letting it slide as a last gesture of goodwill.<\/p>\n\n\n\n That is until she started demanding things of me.<\/p>\n\n\n\n In a nutshell I told her to lick my nutsack and that I wasn’t spending a single penny more on them… let alone a 37\u00a2 stamp. I also let her know that I was well within my rights to cash said check but if she felt really froggy she could put a stop payment on it. She again demanded that I deliver the check to her… or else. Or else what you may ask? Or else she was going to sue me.<\/p>\n\n\n\n I laughed. By all means please do so I can not feel guilty about counter-suing and recovering ALL the costs incurred for the work I performed. “Yes your Honor, I followed up AFTER the Sheriff’s were unable to effect service of process after five attempts. I went out twelve times and was unable to serve the subject. Yes, I did what I could and am owed the full amount including the extra time and mileage as well as court expenses and for my time for appearing in court as well.”<\/p>\n\n\n\n I told her that I would be more than happy to see her in court, and that whenever she had the paperwork ready to give me a call so that I could pick it up personally. I then informed her that if she ever contacted me again other than to inform me where I could pick up the paperwork that it would be considered harassment.<\/p>\n\n\n\n I then hung up the phone… quite relieved that I was done with that business.
